Forensic investigations

Analysis of transactions and detection of financial misconduct
Forensic investigations establish the facts of fraud, misconduct and asset stripping, how they were carried out, the persons involved and the amount of damage caused.
Forensic investigations are carried out on behalf of owners, governing bodies, creditors, insolvency officers and their legal advisers in internal investigations, corporate conflicts, bankruptcy and litigation.
Finappraisal carries out forensic investigations in the main areas
Internal investigations
Review of procurement, contracts, settlements with counterparties and payments where embezzlement, commercial bribery or a conflict of interest of management and staff is suspected
Asset stripping
Reconstructing chains of transactions and payments, and identifying affiliated and pass-through counterparties and the ultimate beneficiaries of funds and property
Damages caused by managers
Calculation of damages caused to the company by the director, members of governing bodies and controlling persons (Article 53.1 of the Civil Code of the Russian Federation)
Challenging the debtor's transactions
Analysis of suspicious and preferential transactions, comparing the price and consideration with market terms (Articles 61.2 and 61.3 of Federal Law No. 127-FZ "On Insolvency (Bankruptcy)")
Subsidiary liability

Deliberate and fictitious bankruptcy
Analysis of the debtor's financial condition and verification of signs of deliberate and fictitious bankruptcy under the Temporary Rules approved by Russian Government Resolution No. 855 dated 27 December 2004
The investigation is based on financial statements and management accounts, bank statements, primary documents, contracts and data from open registers. Finappraisal reconstructs the sequence of transactions, compares transaction prices with market prices and calculates the amount of damage. The result is an analytical report on the violations identified, how they were committed and their consequences, which is used for management decisions, pre-trial claims and applications to law enforcement authorities and the court.
